Use of this site
This site is provided to you free of charge for your personal use. By using this site you agree to be bound by these Terms & Conditions.
These Terms & Conditions govern the use of the site and all the services provided in connection with it.
Your statutory rights are not affected by these Terms & Conditions.
These Terms & Conditions may be amended from time to time and such amendments will come into force on the day following the date of amendment. You should always check to ensure that you agree with them in relation to each transaction you make.
We may at any time make changes to this site and the details (including prices) displayed on it.
The instruction manuals and safety notices that accompany the products ordered should always be read and understood before use is attempted.

Definitions where used:

"this site, site" refers to firelive.info in relation to products for sale on this site by e-commerce only
"customer" the person making a purchase from this site, for their own use

Sales Terms & Conditions
1.1 To order goods through the site, you must be at least 18 years of age.

Delivery
2.1 We endeavour to deliver within 14 working days from receipt of your order, although some items may take up to 28 days. All deliveries are subject to payment authorisation.
2.2 Delivery will be made by our agent between 9am and 5.30pm, Monday to Friday. On larger items our nominated courier company will contact you to arrange a convenient delivery day.
2.3 We shall use reasonable endeavours to meet any date agreed for delivery, but will not be liable for any delay in delivery however caused, or any resulting losses incurred due to failure to deliver.
2.4 All goods must be signed for by an adult aged 18 years or over on delivery, and must indicate the condition of those items. If our courier is unable to obtain a signature your order will not be left and you may incur an additional charge to redeliver your order.
2.5 Delivery will be made to your door. Placement of your products is at the discretion of the delivery driver. Please be aware that larger vehicles requiring wider access will be used for some deliveries to ensure a tail-lift is available for offloading.
2.6 Delivery charges apply to all areas and these costs will be confirmed at the time you place your order, at which point you will have the opportunity to cancel your order without charge.

Accuracy
3.1 Each order by you represents an offer to purchase goods subject to these Terms & Conditions.
3.2 It is not practical for us to publish comprehensive technical details on this site. Each image, descriptive text and specifications shown on this site are solely to give an approximate description of the goods.
3.3 In relation to 3.2, we cannot be held responsible for the total accuracy of the information that is published, though every effort is made to keep the information as accurate, and up to date as possible.

Intellectual Property
4.1 Copyright, Trademarks and other intellectual property rights protect the content of this site. You may retrieve and display its content on a computer screen, store such content in electronic form on a disk or print one copy for your own personal non-commercial use provided all the copyright and propriety notices are included and kept intact.

Pricing
5.1 Payment required for goods ordered will be stipulated at the time when you place the order. We are entitled to amend any prices, to take account of any increase in supplier prices, the imposition of additional tax or duty and any errors or omissions in respect of the price of the goods (including typographical errors). We will inform you of the prospective change to give you the opportunity to cancel your order. We shall have the right to refuse or cancel, any orders listed at the incorrect price, whether or not the order has been confirmed. Any payment already made will be credited without undue delay by the same method as payment was received.
5.2 The prices published on the site are inclusive of the current rate of VAT. Delivery charges are extra and may vary according to your location and the type of product ordered and therefore, will be confirmed when an order has been received.

Payments
6.1 We accept most major credit and debit cards including Visa, MasterCard and Switch. The range of cards we accept may change without prior notice. When you order you must provide us with your exact billing address and the telephone number your card provider has on file for you. There will be difficulty and delay if these details are incorrect.
6.2 You may also pay by cheque or postal order subject to payment clearance by the bank (usually 10 days) before despatch of your order.

Availability
7.1 All our products and services are subject to availability and may be withdrawn at any time. If goods are not supplied, no charge will be made or a refund, as propriate, will be made. We will not be responsible for any losses suffered by you in relation to our inability to supply.
7.2 We will endeavour to deliver within the specified times but we cannot be held liable for any losses that you may suffer in the event of delay. We will notify you if it becomes apparent that delivery will be delayed so that you will have the opportunity to cancel the order.

Title & Risk
8.1 As soon as the goods are delivered to you they become your responsibility. We will deliver only to the address on the order, and goods will not be left without a signature. From the time of receipted delivery, any loss or damage to the goods will be your responsibility and at your risk. Any transit damage, shortages or wrong goods supplied, must be noted on the delivery/consignment note at the time of delivery.
8.2 After you have paid for and signed for receipt of the goods, you will be their owner. We will issue an invoice, either electronically or by post, upon despatch of the goods.
8.3 Not withstanding any other provision herein, title in the products shall not pass to the customer until the company has received payment in full and all funds have cleared.

Returns
9.1 Transit damage, shortages or wrong goods noted on the consignment note must be notified to us within 3 working days from delivery.
9.2 You must notify us of non-delivery of expected orders within 3 days of the due date. Failure to do this will mean that you will be responsible for any goods lost.
9.3 Goods returned under clauses 9.1 and 9.2 that are found to be undamaged and in full working order will be re-delivered to you. An administration charge along with the delivery charge (or actual carriage cost, whichever is the greater) will be charged to your credit/debit card account.
9.4 Other than for items described in clauses 9.1 and 9.2, if you are not totally satisfied with your purchase, for any reason, you have the right to cancel your order within 7 days of delivery and return the goods to us, in the original packaging. These goods must be in pristine, saleable condition and full working order, complete with all parts and undamaged original packaging. You will be wholly responsible for the return of the goods and any associated costs. We may, at our discretion, arrange on your behalf for the goods to be collected from you and your credit or debit card will be charged with the cost. A Goods Return Authorisation note will be issued to you and must accompany all returns. Goods returned in this way that are incomplete, damaged or in any way unsaleable, will be re-delivered to you. An administration charge along with the delivery charge (or actual carriage cost, whichever is the greater) will be charged to your credit/debit card account. Where goods are being returned in this way, you must contact us to let us know, and the goods must be despatched to us within 7 working days of such notification. If either notification or despatch extends beyond these time limits, your right to cancel will be revoked.
9.5 It is your responsibility to ensure that the goods you order are suitable for use in your home. We urge you to check all measurements and installation requirements before ordering the product. We may at our discretion allow you to return unwanted goods for exchange, however, we will make a re-stocking charge of 25% of the product price for this service. Delivery and collection charges will also apply.
9.6 To arrange a return you should contact us to establish the circumstances and we may then issue a Goods Return Authorisation note and arrange for the goods to be returned to us. Returns cannot be made later than 7 days from the date of delivery.

Enforcement
10.1 We may fail on occasion to enforce any of these Terms & Conditions but this will not affect our right to enforce the remainder of them or to enforce all of them at some future date.
10.2 We will be neither responsible, nor liable for any breach of these Terms & Conditions brought about by circumstances beyond our control.
10.3 We reserve the right to refuse to supply any goods ordered for any reason.

Force Majeure
11.1 Neither party shall be liable for any default due to any act of God, war, strikes, lock outs, accidents, fire, breakdown of plant or machinery or shortage, or unavailability of raw materials from a natural source of supply.
11.2 We shall be entitled to delay or cancel delivery, or to reduce the amount delivered, if the product is unavailable or delayed in manufacturing, or we suffer difficulties in obtaining or delivering the products by normal routes or means of delivery through circumstances beyond our control.

Privacy & Security
12.1 All personal details that you give us are securely stored. We do not supply or sell customers details to any outside organisation. We will endeavour to take all reasonable care, in so far as it is possible to do so, to keep all details of your order and payment secure, but, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering.
12.2 All credit and debit card details are encrypted using 128 bit encryption and sent over a secure server. They are only decrypted after they reach our computer. They are not held in clear text on any web site.

13.1 We do not accept any liability for any website not under our control, which may act as a portal to our site, or be connected by a link with our site, or that we connect by a link to.

Governing Law and Jurisdiction
This contract is subject to the law of England and Wales. All disputes arising out of this contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.
